Terms of Use

These Terms are a contract between you and Firenze Programação de Sites e Aplicativos Ltda. (CNPJ 66.777.790/0001-24), which develops and operates the Quirky app. By creating an account you agree to these Terms and to our Privacy Policy.

1. Who may use Quirky

Quirky is exclusively for people aged 18 or over. By creating an account you declare that you are at least 18, that you have legal capacity to contract, and that you have never had an account removed for breaching these Terms.

2. Your account

The information you provide must be truthful and about yourself.
Your account is personal and non-transferable. You are responsible for keeping your password secret.
You may close your account whenever you wish, from inside the app. See how to delete your account.

3. Community rules

Quirky exists to bring people together in a light-hearted way. For that to work, it is forbidden to:

post explicit nudity, pornography or sexually explicit content;
harass, threaten, humiliate, stalk or discriminate against anyone;
post content involving minors in any sexual or suggestive context;
impersonate another person or use photos that are not yours;
use the app for prostitution, grooming, human trafficking or any illegal activity;
send spam, chain messages, scams, malicious links or unauthorised advertising;
scrape other users' data, automate access or attempt to circumvent the app's protections;
post third parties' personal data without their permission.

4. Content you post

You remain the owner of your quirks, photos, videos and messages. By posting them you grant us a free, limited licence to store, display and distribute that content within the app, only to the people you chose to reach, and only while it remains posted.

That licence ends when you delete the content or your account. We do not use your photos in advertising and do not license them to third parties.

5. Testimonies

Quirky lets other people write testimonies about you. No testimony appears on your profile without your approval. You decide what to publish and may remove a testimony at any time. Testimonies breaching these Terms will be removed.

6. Moderation, suspension and termination

Images undergo automated analysis before becoming visible and may be rejected. We investigate reports. We may remove content and suspend or terminate accounts that breach these Terms or the law — in serious cases, without prior notice.

If you disagree with an automated decision, you may request human review by email.

7. Meeting people safely

Please read carefully. Quirky only introduces people. We do not run criminal background checks, we do not confirm identity beyond the selfie verification, and we cannot guarantee that anyone is who they claim to be.

Deciding to chat with or meet another person is your decision and at your own risk. We recommend: meet in public places, tell someone you trust, arrange your own transport, and never send money to someone you met on the app. If a crime occurs, contact the police — and report it to us.

8. Quirky Premium

The app may offer paid features under the name Quirky Premium. In this version paid features are disabled and nothing is charged. When enabled, pricing, renewal and cancellation terms will be shown before purchase, and billing will follow App Store or Google Play rules.

9. Intellectual property

The Quirky name, brand, logo, design, texts and code belong to Firenze Programação de Sites e Aplicativos Ltda. You may not copy, modify, distribute, sell, rent or reverse-engineer any part of the app.

10. Availability and liability

We work to keep Quirky running, but the service is provided as is. We do not guarantee that you will get matches, nor that the app will be available without interruption or free of faults.

To the extent permitted by Brazilian law, including the Consumer Protection Code, we are not liable for the conduct of other users, inside or outside the app, nor for damage arising from third-party misuse of your account.

11. Changes to these Terms

We may update these Terms. Material changes will be announced inside the app before taking effect. If you disagree, you may close your account.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo/SP shall have jurisdiction, without prejudice to a consumer's right to sue in their own domicile.
